Puppy & Kitten Club Terms and Conditions

1. Information on how to become a member of the Purina Puppy & Kitten Club (“the Club”) & any prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2. Entry to the Club is open to residents of Australia only. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter. You must be aged 18 years or over to join the Club.

3. The Purina Puppy & Kitten Club opens on 19th May 2008 & will remain open on an ongoing basis until the Promoter announces otherwise (“Promotion Period”).

4. To join the Club, simply visit www.purina.com.au and sign up online. All mandatory fields must be completed for an entry to be deemed valid.
a) Mandatory fields include a series of profiling questions. These questions relate to the following information:
i Contact information
ii Preferred shopping channel
iii Attitudes towards the pet
iv Preferred feeding choices and food preparation
v Pet’s details – size, age, breed, birthdate etc
b) The responses to these questions will determine which Purina brand is most suitable for the pet. Based on this, a brand will automatically be assigned to each entrant, and this will define which communications will be dispatched to them and the method of communication they will receive.
c) Methods of communication can include telephone, email or mail.

5. Any form of automated entry using any other devices or software is invalid.

6. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, or for submitting an entry that is not in accordance with these Conditions of Entry.

7. By joining the Club, members agree to receive communications in various forms from Purina for the duration of the program, or until they supply written/email confirmation of their wish to opt-out of the programme.

8. If the promoter receives returned mail from a member’s postal address, the promoter reserves the right to continue email communications to the member, until such time that the member supplies written/email confirmation of their wish to opt-out of email communications.

9. By joining the Club, entrants are entitled to receive SOME of the following items as part of a welcome pack and ongoing communications. Which of the following items they receive, is dependant on which Purina brand the member has been assigned to. Some members will be assigned brands that receive only ‘virtual’ or digital versions of communications and may also receive links to items for download:

a) A4 Puppy OR Kitten Guide 40pp Brochure (either in printed form or as a link to download the item online)
b) Welcome letter OR welcome email
c) Cash back offer of $2.50 (not available to all entrants – other Terms and Conditions apply)
d) Sample of puppy/kitten food as follows (not available to all entrants)
i A 200g sample of PURINA ONE Puppy food (only available to members assigned to the PURINA ONE brand, who have a puppy)
ii A 100g sample of PURINA ONE Kitten food (only available to members assigned to the PURINA ONE brand, who have a kitten)
iii A 200g sample of SUPERCOAT Puppy food (only available to members assigned to the SUPERCOAT brand, who have a puppy)
iv A 400g sample of PRO PLAN Puppy food (only available to members assigned to the PRO PLAN brand, who have a puppy)
v A 200g sample of PRO PLAN Kitten food (only available to members assigned to the PRO PLAN brand, who have a kitten)
e) TOTAL CARE items (not available to all entrants):
i TOTAL CARE Reflective paw lead (only available to members assigned to the PURINA ONE or the SUPERCOAT brand, who have a puppy)
ii TOTAL CARE Stripe Cat Collar (only available to members assigned to the PURINA ONE brand, who have a kitten)
f) National Pet Care Register Flyer (not available to all entrants)
g) Measuring cup (not available to all entrants)
h) DL Range Flyer (not available to all entrants)
i) A4 Stockist List (not available to all entrants)
j) Voucher for $5 off PRO PLAN Puppy OR Kitten food (not available to all entrants – only available to members assigned to the PRO PLAN brand, who have a kitten OR a puppy)
10. By joining the Club, entrants agree to receive regular email, postal or telephone communications during the 1 to 2 years from entry submission.
Promoter accepts no responsibility for variations in item value and reserves the right to substitute or remove items from the programme without notice.

11. Entrants will receive their initial welcome pack within 28 days of entry submission, either via email or by mail.

12. Entrants are entitled to welcome packs as follows: Limited to a maximum of 2 puppy welcome packs per household, per year OR a maximum of 2 kitten welcome packs per household, per year OR a maximum of 1 puppy welcome pack and 1 kitten welcome pack per household, per year
13. Supply of welcome packs is dependant on the age of the pet - they are only supplied for kittens and puppies of the following ages:
a) Kittens – for kittens up to 9 months old
b) Toy, Small or Medium dogs (as defined by Purina) – for puppies up to 9 months old
c) Large dogs (as defined by Purina) – for puppies up to 15 months old
d) Giant dogs (as defined by Purina) – for puppies up to 21 months old

14. Welcome packs are not transferable & cannot be taken as cash, unless otherwise stipulated.

15. Welcome pack contents are correct at time of printing but no responsibility is accepted for variation in any items.

16. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the welcome pack, except for any liability which cannot be excluded by law.

17. All entries become the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.com.au or calling 1800 005 510.

18. Promoter’s decision is final and no correspondence will be entered into.

19. Members should look to the manufacturer of products supplied for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

20. By joining the Club, the entrant agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

21. Welcome packs will only be delivered in Australia and winners should allow 28 days from submitting their entry for delivery/email of their pack.

22. If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

23. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Purina PetCare Survey Promotion

1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2. Entry is open to residents of Australia who are 18 years of age or over who have a valid email address, (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter.

3. The Promotion commences on Tuesday 1/06/2010 & closes at 11.59pm Australian Eastern Standard Time (“AEST”) on Tuesday 30/11/2010 (“Promotion Period”).

4. To enter the prize draw, complete the Purina PetCare Survey found at www.purina.com.au

5. Entry is limited to once per Eligible Entrant.

6. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to sending multiple entries or using any form of automated entry method using other devices or software or for otherwise submitting an entry that is not in accordance with these conditions of entry.

7. Prize is a red HDRCX110R SONY HANDYCAM® High Definition Flash Memory Camcorder valued at $799 recommended retail price (“RRP”). There are a total of 6 prizes to be awarded during the Promotion Period.

8. All valid entries received during the Promotion Period will be entered in the next occurring monthly prize draw and all non-winning entries will roll into all remaining monthly prize draws.

9. Prize Draws: All prize draws will occur at 10am on the second Tuesday of every month, commencing with the 1st draw on Tuesday, 13/07/2010 and the final draw on Tuesday, 14/12/2010, (total of 6 monthly draws). Draws will be conducted at Unit 4B, 106 Old Pittwater Road, Brookvale NSW 2100. The first valid entry drawn each month will win the prize.

10. All Winners will be notified by mail and their name and postcode will be published in The Australian on the last Tuesday of the month when the draw occurred, (ie. PURINA Adult Transition Programme Terms and Conditions

1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2. Entry is open to residents of Australia who are members of The Purina Puppy & Kitten Club®. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter.

3. The Promotion commences on Monday 5th October 2009 & closes at 11.59pm Australian Eastern Standard Time (“AEST”) on Tuesday 5th October 2010 (“Promotion Period”).

4. To enter the prize draw, complete the questionnaire found at www.purina.com.au

5. Limit of one entry per household (based on street address).

6. PURINA Pet Txt Terms and Conditions

1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2. Entry is open to registered members of Nestlé Purina PetCare's PetTXT programme. Only Australian residents who are employees of businesses that are retail partners and product stockists of Nestlé Purina PetCare products ("Eligible Businesses") are eligible to register for the PetTXT programme. If you cease employment at an Eligible Business, you are no longer eligible to be a member of the PetTXT programme or to enter the promotion. Employees of the Promoter, the Promoter's related companies, the Promoter's agencies associated with the running of this competition and their immediate families are ineligible to enter.

The promotion commences at 9am Australian Eastern Daylight Time ("AEDT") on Monday 2 November 2009 & closes at 2pm AEDT on Tuesday 2 November 2010 ("Promotion Period"). Each month during the Promotion Period entries in each prize draw will close 2 hours before the draw will occur (refer to clause 14 below).

3. To be eligible to enter the monthly promotions throughout the promotional period (refer to clause 2), the eligible entrant needs to register for the draw by answering the monthly question as part of the ongoing PetTXT programme 2pm on the day of the draw by sending a reply SMS with the answer to 19 799 799 from your mobile phone. For more details please refer to clause 5. Entrants are required to register for the PetTXT programme once to be eligible to enter these monthly promotions.
To ensure against additional costs being incurred if your mobile phone receives messages while outside Australia, you must unsubscribe from the PetTXT programme before taking your mobile phone outside of Australia (see clause 10 below).

4. There are 12 draws during the Promotion Period. If you register for the PetTXT programme before the 1st day of any month during the Promotion Period, you will be eligible to enter that month's prize draw, and all subsequent prize draws.

5. You can unsubscribe from the PetTXT programme at any time by sending SMS with PROPLAN STOP to 19 799 799. If you unsubscribe from the PetTXT programme, you will be ineligible to enter any prize draw that occurs after the date you unsubscribed.

6. To enter a draw, respond as directed by SMS when you receive an invitation by SMS to your mobile phone number to answer a question and enter the monthly draw.

7. Entries in each monthly prize draw must be received in the Promoter's database no later than two hours prior to the scheduled prize draw (refer to clause 13)

8. Entry is limited to once per person per prize draw. Any form of automated entry using any other devices or software is invalid.

9. The Promoter reserves the right to verify the employment status and the validity of all entries. The Promoter further reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques designed to avoid payment of call costs or for making multiple entries or for submitting an entry which is not in accordance with these conditions of entry.

10. The cost of sending an SMS entry is the responsibility of the entrant and will vary depending on the mobile network used. Total cost of SMS entry will not exceed 55 cents including GST. Note that text entry may not be available from all mobile phone carriers or plans. To ensure against additional costs being incurred if your mobile phone receives messages while outside Australia, you must unsubscribe from the PetTXT programme before taking your mobile phone outside of Australia. To re register for the program please refer to the initial registration material.

11. All entries containing the correct answer to the monthly question will be entered into the monthly prize draw. The first 2 valid entries drawn in each prize draw will win a Prize.

12. The Prize is the winner's choice of one of the following prizes:
a. $100 Myer Shopping Voucher; or
b. $100 Westfield Gift card; or
c. $100 Air Time Credit with the winner's choice of service provider (Vodafone; Optus; Virgin, 3 or Telstra)
d. Double Gold Class Movie Voucher valued at $72 recommended retail price ("RRP") redeemable from Birch Carroll and Coyle Cinemas. Each prize will be subject to the issuer's terms of use. There will be a total of 24 prizes awarded.

13. The monthly prize draw will be conducted on the 2nd Tuesday of each month at 4pm AEDT or Australian Eastern Standard Time (which ever applies) at Unit 6, 106 Old Pittwater Road, Brookvale NSW 2100 commencing Tuesday 8 December 2009 and concluding on Tuesday 9 November 2010.

14. All prize winners will be notified by phone within two days of the draw, when they will be asked to nominate the prize they would like to receive. Winners' names and postcodes will appear at www.purina.com.au.

15. Total prize pool is valued at up to $2,400 RRP.

16. Prizes are not transferable & cannot be taken as cash, unless otherwise stipulated.

17. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.

18. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.

22. The winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties and conditions of use. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

23. In the event that any prize item is unavailable despite the Promoter's reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.

24. Prizes will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.

25. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion.
